The goal of estate planning is to give you control over the eventual distribution of your assets to those persons and organizations you wish to recognize and honor. Estate planning also provides the opportunity to maximize your estate by minimizing the future costs and fees to your beneficiaries during the probate process.


Probate is the most misunderstood legal term I encounter in my practice. Probate is the process whereby a ``testate`` (with a will) or ``intestate`` (without a will) estate is distributed to the appropriate beneficiaries by the court. The process includes transferring real estate, vehicles, and noticing creditors that a death has occurred. A probate may be contested or uncontested depending on whether or not the ``beneficiaries`` are in agreement with the inventory, payment of debts, and distribution of assets.


Trust Administration is the process whereby a trustee manages and distributes trust assets for the benefit of the beneficiaries in accordance with the terms of a trust. There are several different types of trusts that each serve a specific purpose. The most common trust is the family or individual ``revocable`` living trust that is distributed to the beneficiaries upon the death of the original trustee.


Personal Injury is a broad term that encompasses those accidents where a person is injured through no fault of their own. Most of these incidents are due to automobile accidents, animal attacks, or a ``slip and fall`` at a business or private residence.

After serving in the United States Air Force as a jet engine mechanic, Ms. Romaine was honorably discharged to attend St. Thomas University School of Law in Miami.  After earning her Juris Doctor in December 2002, she was hired as an associate in a Melbourne law firm that focused on personal injury and civil litigation.  In May of 2005, Ms. Romaine formed the Law Office of A. M. Romaine, PA.  Today, this practice is dedicated to handling estate planning, trust administration, probate, guardianship, and personal injury on behalf of our clients.

Attorney Jennifer Jen” Kerkhoff relocated to the Space Coast from Central Florida and maintains a strong network of associates and professional service providers throughout the State to assist with all of her clients’ needs. While working in academe, her research interests began focusing on elderly abuse and exploitation. Today, in addition to practicing law, she continues to lecture, speak at conferences, and advocate for the elderly. For over three years, Ms. Kerkhoff was a trial court staff attorney for the Eighth Judicial Circuit, where she drafted orders and memorandums of law for circuit court judges on a variety of issues and dockets while also maintaining the probate and guardianship dockets in Levy and Gilchrist Counties. From criminal defense to civil practice, Ms. Kerkhoff has a broad knowledge and practice base and consults on complex cases throughout the State of Florida. Her clients consist of individuals, corporations, trusts, and 501(c)(3) charitable entities. At this time, she is accepting new clients in the areas of estate planning and probate and trust matters. Finally, after all documents are executed we send the original documents home with you, we keep a copy for our files, and if necessary we either file or record your documents in the appropriate county.
